1. INTRODUCTION

1.1 Background

The objectives of the Shanah are human welfare justice and protection of mankind from all kinds of harms and to ordain life in a way that all the means of loss and destruction can be faced The principles of deduction followed by the Imams and their companions explicitly support this view They have accepted public welfare as a proof of anything becoming permissible in Shariah All actions oriented to this welfare apparently or really material as well as spiritual are significant in Islamic Shariah

Imam Ibn Taymia and Ibn al Qaiyem in their deductions have contributed to this aspect supporting the above point of view Imam Taymia emphasized this issue so much that he advocated to establish the institution of Hisba to look after the realization of welfare Imam Ibn-al- Qaiyem writes The objective of the Shariah is the establishment of justice which is the very foundation of Allah’s creation It must have to conform to the needs of justice in whatever way these laws are formulated Most important consideration is the basic objectives of law rather than how it was obtained

From the comparison of the above views it can be assumed that perhaps no where in the world in any religion or in any social system or even in the economy (applicable wherein) – an institution like that of Zakah in Islam so vastly significant will be rarely found No doubt the existing religions encourage charity and to do good deeds, but charity as such is not obligatory in any other case. It is Islam which has ordained Zakah as a religious concern on every capable Muslim It is established that the most striking yard stick of Zakah is its obligatory character Zakah combines the concepts of moral and social obligation as compulsory factor in the Islamic way of life A Quran says about Zakah
